Minutes of The Task Force on Faculty Governance

October 3, 2002

Attending: Russell Church, Anne Fausto-Sterling, Richard Fishman, Peter Gromet, John Savage, Rajiv Vohra, and Michael White.

  1. The opened at 1:06pm and adjourned at 4:15pm.

  2. The minutes of September 26 were approved.

  3. Discussion of Proposed Committee on Grievance

    General Counsel Beverly Ledbetter sat with us to review this proposed committee. Paragraph A. of the charge was revised to permit grievances to be filed with the committee by members of the Faculty as well as a members of the teaching or research staff. They can be filed against other such individuals and members of the Administration.

    Paragraph A., iv. was revised to allow charges of "abridgment of rights as members of the university ACADEMIC community."

    Paragraph 4. under the Charge was modified by deleting the first sentence. The remaining sentences say that access of the Medical School faculty who are not employed by Brown is limited to issues arising from their role as faculty members in activities under the control of the University.

    We added a new paragraph 5. from the current grievance procedures that says that this committee cannot be used to appeal a formal grievance that has been pursued using some other established grievance procedure within the University.

    We deleted paragraph 8. and revised 9. to replace "unlawful discrimination" with discrimination in violation of the University's non-discrimination policy.

  4. Faculty Diversity Subcommittee

    We approved the following a draft description of this committee.

       CHARGE
       The Faculty Diversity Committee (FDS) is a standing subcommittee of the
       Faculty Affairs Committee (FAC) with a separately elected membership.
       
       The FDS shall to work with the Diversity Officer, the Deans of the Faculty
       of Biology and Medicine, and FAC to devise a plan for improving faculty
       diversity at Brown whose progress it shall monitor. It shall  
    
       *  Work with the FAC to articulate goals for a more diverse faculty, and
          provide a strategy to achieve them. 
    
       *  Assess the effectiveness of departments and programs in achieving
          a diversity that reflects the pool of qualified applicants.
    
       *  Work with departments to identify strategies for improving
          diversity in the applicant pool.
    
       *  Monitor the progress of current searches by reviewing monthly summary
          reports of searches provided to the FDS by the Deans of the Faculty and
          Biology and Medicine.  These reports shall list current searches, job
          descriptions and recruitment plans, the national pools appropriate for
          field and rank, the applicant pool broken down by legally protected
          minority categories, and the breakdown of the short list and the final
          hiring decision. When indicated, the Deans shall refer questionable
          cases to the FDS for an expedited review.  When needed, the FDS shall
          ask the Deans for information about individual ongoing searches.
    
       MEMBERSHIP 
       The Committee shall have five tenured faculty members.
    
       ELECTIONS
       Three members shall be elected in odd numbered years and two shall be
       elected in even numbered years for two-year terms.
    
       REPORTING
       Each semester, the FDS will provide a report on its work to FAC for
       discussion. The FDS will submit an annual written report to FAC on its 
       activities which FAC shall include in its annual report to the Faculty. 
    

  5. Faculty Affairs Committee

    We modified the charge by deleting "grievances" from the first sentence and modified item d. so it reads "It shall assess, promote and review Universities policies and practices relating to diversity and non-discrimination (footnote) in support of which it shall be provided reports on faculty hiring twice annually by the Office of Faculty Personnel." The footnote lists the Corporation statement on non-diversity.

  6. TPA

    Today AMC grants an automatic review of denial of promotion or reappointment to women and minorities. We have recommended that this provision not be carried forward. At this meeting we debated the merit of granting automatic review of such denials to all faculty members. Concern was expressed that such reviews might become so automatic as to deny affected faculty members the full hearing that may need. No conclusion was drawn on this issue.
